# End User License Agreement (EULA) for Pollen

## Introduction

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "You") and Denis Vizigin ("Company," "we," "us," or "our") for the Pollen mobile application ("App") for iOS devices. By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement.

## 1. Grant of License

### 1.1 License Grant
Subject to the terms of this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your iOS device solely for your personal, non-commercial use.

### 1.2 License Restrictions
You may NOT:
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse engineer, decompile, or disassemble the App
- Remove or alter any proprietary notices or labels
- Use the App for any commercial purpose without written permission
- Attempt to gain unauthorized access to any services, accounts, or networks

## 2. Subscription Services

### 2.1 Premium Features
The App offers premium subscription services that provide enhanced features including:
- Advanced pollen forecasts and detailed analytics
- Extended forecast periods
- Priority customer support
- Ad-free experience

### 2.2 Subscription Terms
- Subscriptions are available as monthly ($14.99/month) or annual ($39.99/year) plans
- Prices may vary by region and are subject to change
- Payment will be charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel your subscriptions by going to your Apple ID account settings

### 2.3 Free Trial
If offered, free trials are for new subscribers only and may be subject to cancellation at our discretion.

## 3. Privacy and Data Collection

### 3.1 Data Collection
The App collects and processes the following data:
- Location information (to provide accurate pollen forecasts)
- Device information and usage analytics
- Crash reports and error logs for improvement purposes
- Subscription and purchase information

### 3.2 Privacy Policy
Your privacy is important to us. Please review our Privacy Policy, which is incorporated into this Agreement by reference, for detailed information about our data practices.

## 4. User Responsibilities

### 4.1 Accurate Information
You are responsible for ensuring that any information you provide is accurate and up-to-date.

### 4.2 Device Requirements
The App requires:
- iOS 17.0 or later
- Internet connection for data synchronization
- Location services enabled for accurate forecasts

### 4.3 Prohibited Uses
You agree NOT to use the App to:
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Distribute harmful software or content
- Attempt to interfere with the App's operation

## 5. Intellectual Property

### 5.1 Ownership
The App and all its content, features, and functionality are owned by Denis Vizigin and are protected by copyright, trademark, and other intellectual property laws.

### 5.2 Third-Party Content
The App may include content from third-party sources, including weather and pollen data providers. Such content is owned by the respective third parties.

## 6. Disclaimers and Limitations

### 6.1 Health Information Disclaimer
**IMPORTANT:** The App provides general pollen information and forecasts for informational purposes only. This information is NOT a substitute for professional medical advice, diagnosis, or treatment. Always consult with qualified healthcare professionals regarding any medical concerns or conditions related to pollen allergies.

### 6.2 Accuracy of Information
While we strive to provide accurate and up-to-date pollen information, we cannot guarantee the accuracy, completeness, or timeliness of any data provided through the App.

### 6.3 Service Availability
We do not guarantee that the App will be available at all times. Service may be interrupted for maintenance, updates, or due to circumstances beyond our control.

## 7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
- WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE LAST 12 MONTHS
- WE ARE NOT RESPONSIBLE FOR ANY HEALTH CONSEQUENCES RESULTING FROM RELIANCE ON THE APP'S INFORMATION

## 8. Termination

### 8.1 Termination by User
You may terminate this Agreement by deleting the App from your device and discontinuing its use.

### 8.2 Termination by Company
We may terminate this Agreement immediately if you breach any terms, with or without notice.

### 8.3 Effect of Termination
Upon termination, your right to use the App ceases immediately, but provisions regarding intellectual property, disclaimers, and limitations of liability will survive.

## 9. Updates and Changes

### 9.1 App Updates
We may provide updates to the App to improve functionality, fix bugs, or add features. Some updates may be required for continued use.

### 9.2 Agreement Changes
We may modify this Agreement at any time. Changes will be effective upon posting the updated Agreement in the App or on our website. Continued use constitutes acceptance of changes.

## 10. Geographic Restrictions

The App is intended for use worldwide, but availability and functionality may vary by region due to local laws or data availability.

## 14. Entire Agreement

This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and us regarding the App.

## 15. Apple App Store Terms

If you downloaded the App from the Apple App Store, you acknowledge that:
- This Agreement is between you and Denis Vizigin, not Apple
- Apple is not responsible for the App or its content
- Apple has no obligation to provide maintenance or support services
- Apple is not liable for any claims related to the App
- Any product claims must be directed to Denis Vizigin, not Apple
